1. Acceptance of Terms

By accessing or using Lodgaro (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you may not use the Service. These Terms apply to all users who access or use the Service.

2. Description of Service

Lodgaro provides a platform for vacation rental property owners to:

• Create and manage their own branded booking websites
• Accept direct bookings and process guest payments via Stripe
• Manage property listings, photos, pricing, and seasonal rates
• Sync availability via iCal calendar feeds
• Connect custom domains to their booking site
• Manage bookings, payouts, and guest communications

Lodgaro is a technology platform. We do not own, control, or manage any properties listed on the platform, and we are not a party to any agreement between you and your guests.

3. Account Registration

To use the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Keep your account information up to date
• Maintain the security of your password
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use at support@lodgaro.com

You must be at least 18 years old to create an account.

4. Subscription Plans & Payments

4.1 Available Plans

Lodgaro offers the following plans (current pricing on our pricing page):

• Flex: Free to use. A 3% commission is charged on each booking payment processed through Lodgaro. Up to 2 website generations per calendar month.
• Pro: Monthly or annual subscription. Unlimited website generations, seasonal pricing, and no booking commission.
• Portfolio: Monthly or annual subscription. Everything in Pro, with support for multiple properties.

4.2 Billing

• Subscriptions (Pro, Portfolio) are billed in advance on a monthly or annual basis
• Flex commission (3%) is deducted automatically at the time of each booking payment
• All fees are exclusive of applicable taxes
• We reserve the right to modify pricing with 30 days' advance notice

4.3 Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, your account remains active until the end of the current billing period. No refunds are provided for partial months or unused periods.

5. User Content

5.1 Ownership

You retain ownership of all content you upload (property photos, descriptions, pricing, etc.). By uploading content, you grant Lodgaro a worldwide, non-exclusive, royalty-free license to use, display, and distribute this content solely to operate and improve the Service.

5.2 Content Guidelines

You agree not to upload content that:

• Infringes on any intellectual property rights
• Is false, misleading, or fraudulent
• Is illegal, harmful, abusive, or offensive
• Contains malware or harmful code

5.3 Property Listings

You represent that you have the legal right to rent the properties you list and that all listing information is accurate and compliant with local regulations.

6. Bookings & Payments

6.1 Direct Relationship

Bookings create a direct contractual relationship between you (the host) and your guest. Lodgaro is not a party to this relationship and is not responsible for disputes between hosts and guests.

6.2 Payment Processing

Guest payments are processed through Stripe. By using our payment features, you also agree to Stripe's Terms of Service. Lodgaro is not responsible for payment processing errors, chargebacks, or disputes handled by Stripe.

6.3 Your Responsibilities as Host

• Setting accurate prices, policies, and availability
• Honoring all confirmed bookings
• Complying with all applicable local laws and rental regulations
• Collecting and remitting any applicable tourist taxes or VAT
• Maintaining appropriate insurance coverage for your property

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with or disrupt the Service or other users
• Use automated systems to access the Service without prior written permission
• Engage in fraudulent activities, including creating fake bookings
• Reverse-engineer, copy, or create derivative works of the Service

8. Intellectual Property

The Lodgaro platform, including its design, code, features, and branding (excluding user-uploaded content), is owned by Lodgaro and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary materials.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not guarantee the accuracy or completeness of any content on the platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LODGARO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

In all cases, our total liability to you shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lodgaro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

12. Termination

We may suspend or terminate your account immediately, without prior notice, if we believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the platform.

You may delete your account at any time. Upon termination, your right to use the Service will cease immediately. We will retain certain data as required by law (see our Privacy Policy).

13. Governing Law

These Terms are governed by the laws of Belgium, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.

14. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will notify you by email and display a prominent notice in the platform at least 14 days before the change takes effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.
